Terms of Service

Welcome to Tera Mera Hisaab (“TMH”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of the TMH mobile applications, websites (including teramerahisaab.com), and related services (collectively, the “Services”). By creating an account, downloading, installing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
TMH is provided by OOR DEVELOPER, having its registered office at Digvijay Plot, Jamnagar, Gujarat, India 361005. Contact: support@teramerahisaab.com.
1. Who Can Use TMH
- You must be at least 18 years old and capable of forming a binding contract under applicable law.
- You agree to provide accurate account information and keep it updated (e.g., phone number for OTP login).
- The Services are intended for individuals and businesses to record sales, expenses, credit/udhar, and payments. We do not provide legal, tax, or accounting advice.
2. Your Account & Security
- You are responsible for all activities that occur under your account and for maintaining the confidentiality of your device, SIM/OTP access, and any PINs you set.
- Notify us immediately at support@teramerahisaab.com if you suspect unauthorized use.
- We may restrict, suspend, or terminate accounts that violate these Terms.
3. Subscriptions, Plans & Billing
TMH offers a Free plan and paid plans (e.g., PRO, Business) with different features and fair-use limits. Plan details shown in-app or on the website form part of these Terms.
- Billing through Google Play: If you purchase a subscription via Google Play, Google collects payment and handles renewals, cancellations, and some refunds. Manage or cancel at Google Play > Payments & Subscriptions.
- Renewals: Paid subscriptions automatically renew unless cancelled before the renewal date. Your access continues until the current billing period ends.
- Taxes: Prices may exclude taxes. Where applicable, GST or other taxes will be added. Tax invoices may be requested at billing@teramerahisaab.com.
- Trial & Credits: We may offer trials, credits, or promotional limits (e.g., AI/voice/OCR credits). We may modify these at any time with reasonable notice.
- Refunds: See Section 15 (Refunds) below. Where you subscribed via Google Play, its refund rules apply.
4. Features & Third-Party Services
TMH may use third-party technologies to power certain features such as speech-to-text, AI parsing/summary, OCR (image-to-text), ads, analytics, or cloud sync. Examples include (but are not limited to) Google Speech Services, Google Cloud/Gemini, on-device models, ML Kit OCR, and ad networks.
- By using these features you agree to their processing of your data as described in our Privacy Policy.
- Availability, accuracy, and language support may vary by device, OS, and network conditions.
- Voice features are not a substitute for human review. Always verify important entries.
5. Your Content & Data
- “User Content” includes entries, customer lists, amounts, images, voice notes, labels, and other data you upload or create in TMH.
- You retain ownership of your User Content. You grant TMH a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display your User Content solely to provide and improve the Services.
- You are solely responsible for the accuracy and legality of your User Content and for obtaining any consents required (e.g., sending reminders to your customers).
- We may aggregate and de-identify data to improve the Services and for analytics. Aggregated/de-identified data is not personal data.
6. Acceptable Use
You agree not to:
- Use TMH for unlawful purposes or to infringe others’ rights.
- Upload malicious code, attempt to reverse engineer, or disrupt the Services.
- Misrepresent transactions, spam customers, or violate communications/privacy laws.
- Use AI or OCR features to process content you have no right to use.
7. Communications & Reminders
- TMH may send transactional messages (e.g., OTPs, alerts, due reminders) via in-app notifications, email, SMS, or WhatsApp (where available). Message delivery is not guaranteed.
- When you send reminders/notices to your customers via TMH, you are the sender of record and must comply with applicable laws, DND/NCPR rules, and consent requirements.
8. AI/Voice/OCR Limits & Fair Use
- Plans include monthly/daily limits or fair-use thresholds (e.g., entries, AI parsing, OCR scans, audio summaries). We may throttle, queue, or temporarily restrict usage to protect service stability.
- Outputs from AI/voice/OCR are generated predictions and may be inaccurate. You must review before relying on them.
9. Ads & Free Plan
- The Free plan may display advertisements. Advertising content is provided by third parties; we are not responsible for their products/services.
- Upgrading to a paid plan removes ads as specified in the plan details.
10. Device Permissions
TMH may request permissions such as microphone, storage/photos, camera, notifications, contacts (optional), and network access. You can revoke permissions in system settings; some features may stop working if permissions are denied.
11. Service Availability & Updates
- We aim for high availability but do not guarantee uninterrupted service. Maintenance, outages, or vendor dependencies may affect availability.
- We may update, add, or remove features (including beta features) with reasonable notice when required.
12. Privacy
Your use of TMH is subject to our Privacy Policy, which explains how we collect, use, and safeguard your information. By using the Services, you consent to our data practices.
13. Intellectual Property
- The Services, including logos, designs, text, graphics, and software, are owned by TMH or its licensors and are protected by law. Except for the limited license to use the app, no rights are transferred to you.
- You may not copy, modify, distribute, sell, or lease any part of the Services without our permission.
14. Feedback
If you submit suggestions or ideas (“Feedback”), you grant us a perpetual, worldwide, irrevocable, royalty-free license to use the Feedback without restriction or compensation.
15. Refunds
- Google Play Purchases: Refunds are governed by Google’s policies. You can request a refund from your Google Play account within their allowable window.
- Direct Purchases (if any): We may provide a pro-rated refund for annual plans within a limited window after purchase if you have not excessively consumed AI/OCR/voice credits. To request, email billing@teramerahisaab.com with your order details.
- One-time consumables, used credits, and promotional bonuses are non-refundable unless required by law.
16. Disclaimers
TMH IS PROVIDED “AS IS” AND “AS AVAILABLE”. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Services will be error-free, accurate, or uninterrupted, or that losses caused by third parties (e.g., telecom providers, clouds, AI vendors) will be prevented.
17. Limitation of Liability
To the maximum extent permitted by law, TMH and its affiliates, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising from your use of the Services. Our total liability for any claim will not exceed the amount you paid to us for the Services in the 3 months preceding the event giving rise to the claim (or INR 1,000 if you use the Free plan).
18. Indemnity
You agree to indemnify and hold harmless TMH from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your use of the Services, or your violation of these Terms or applicable laws.
19. Termination
- You may stop using the Services at any time and, for subscriptions purchased via Google Play, cancel via Play Store settings.
- We may suspend or terminate your access if you violate these Terms, pose risk, or misuse AI/voice/OCR features.
- Upon termination, your license ends; some provisions (e.g., payments due, IP, disclaimers, limitations, indemnity) survive.
20. Governing Law & Dispute Resolution
- These Terms are governed by the laws of India, without regard to conflict-of-laws rules.
- Subject to the arbitration clause below, courts at Jamnagar, Gujarat shall have exclusive jurisdiction.
- Arbitration: Any dispute shall be finally resolved by a sole arbitrator appointed under the Arbitration and Conciliation Act, 1996. Seat and venue: Jamnagar, Gujarat. Proceedings in English.
21. Export & Compliance
You may not use or export the Services in violation of applicable export laws or sanctions. You represent that you are not barred from using the Services under Indian law or other applicable laws.
22. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide reasonable notice (e.g., in-app notice or email). Continued use after the effective date constitutes acceptance of the updated Terms.
23. Electronic Communications & E-Sign
By using TMH, you consent to receive communications electronically and agree that electronic records and signatures have the same legal effect as paper originals.
24. Children
The Services are not directed to individuals under 13. Do not use TMH if you are under the minimum age required by law in your jurisdiction.
